1. Acceptance of Terms

By accessing, browsing, or using the Clinical RE Evaluator application ("the Application"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you are strictly prohibited from using the Application. We reserve the right to update or modify these terms at any time without prior notice. Your continued use of the Application constitutes acceptance of those changes.

2. Strictly Confidential & Authorized Access

Complete Confidentiality: The Application and all data contained within are strictly confidential. Access is restricted exclusively to authorized personnel for approved business purposes.

Prohibited Activities: Under no circumstances may any individual engage in unauthorized access, hacking, penetration testing (without explicit prior written consent), reverse engineering, or data scraping. Any attempt to circumvent security controls or exploit vulnerabilities is a violation of these Terms and will result in immediate termination of access and potential legal action.

3. HIPAA & Protected Health Information (PHI)

If your use case requires the processing of PHI governed by the Health Insurance Portability and Accountability Act (HIPAA), it is your responsibility to ensure a valid BAA is executed prior to any data transmission. In the absence of a BAA, you agree to entirely de-identify any operational data to prevent the inclusion of PHI.

4. Disclaimer & Limitation of Liability

The Application is provided "AS-IS" and "AS-AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

In no event shall we, our directors, employees, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Application.

5. Termination

We may terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms of Use. Upon termination, your right to use the Application will immediately cease.
